Section 244
Imprisonment for misdemeanor or fine

(1) Even during the auction sale of the property in accordance with sub-section (7) of section 242, if the property is not sufficient, if the property is not shown or if the property cannot be auctioned, the person who receives the payment of the remaining property will be entitled to imprison the person who has to pay the property, or if the property has been sold by auction or the situation under this sub-section has occurred. If the application is submitted within a day, the court will have to put up the form and send the person who has to fill it to prison according to the law.
(2) When imprisoning in accordance with sub-section (1), the court shall imprison the person who has to pay the amount of the amount due at the rate of 400 rupees per day.
(3) Imprisonment in accordance with sub-section (1) shall not exceed four years in the case of an offense committed by the Government of Nepal or a public organization wholly or mostly owned or controlled by the Government of Nepal and two years in the case of an offense committed by a private individual or other organization.
(4) In case of imprisonment according to sub-section (1), if the amount is less than 400 rupees or if it remains, he shall be imprisoned for one day.
(5) In the case of imprisonment according to sub-section (1), the person who wants to be imprisoned shall bear the expenses incurred according to the law.
(6) Imprisonment for non-payment of fine shall be for a term not exceeding four years at the rate of two hundred rupees per day.
(7) Before imprisoning according to this section, the concerned person shall be given reasonable time to present his statement.
(8) Regardless of what is written elsewhere in this paragraph, the person who does not pay the debt due to the remaining debt that has not been recovered as per the demand of the party, cannot be claimed again regarding that debt due to being imprisoned according to the order of the court.
